CITY OF WAUBUN MN VACATION OF REMAINDER OF ETHEL AVENUE PUBLIC HEARING JULY 19, 2005 Mayor Peter Haddeland convened the Public Hearing for the vacation of the remainder of Ethel Ave. on Tuesday, July 10, 2005 at 6:00 PM in the Waubun Community Center. Council members present: Peter Haddeland, Milo Winter and Larry Swiers. Council members absent were Ken Kylmanen and Leonard Wells. Property owners and community members present were: Opal Voit, Russ and Gwen Krabbenhoft, Ed Scheler and Ken Johnson. Others: Elroy Hanson, City Attorney and Sandy Haddeland, Recorder. Written responses: Duane and Georgia Dorow and Francis and Karen Monroe. Questions were asked about how the land would be divided and what the tax ramifications of this action would be. Attorney Hanson indicated that the land would be divided 17.5’ to each owner on either side of the presently non-existent alley (only an alley shown on the plat map). Taxes would increase minimally. The city could not issue any guarantees to that affect, however, as that is up to the assessor. The City contracts that task with the County Assessor’s office. He also indicated that an easement would remain in place. The ditch would continue to maintain by the property owners as it is now. Pro’s and con’s were presented by the people present and the written responses were circulated to others. Ken Johnson and Ed Scheler requested that the City build an alley as planned and then the issue would be resolved. A quorum of Council members was present but because this is a special issue it requires that all Council members be present to make a decision. Therefore, the meeting was recessed at 6:30 PM and will reconvene at 6 PM on August 9, 2005 before the regular City Council meeting. _____________________________ Sandy Haddeland, Recorder ------------------------------------------------------------------------------------------------------------ TUESDAY, AUGUST 9, 2005 Ethel Avenue Vacation meeting reconvened at 6:00 PM Council Members present: Ken Kylmanen, Milo Winter, Leonard Wells, Larry Swiers and Peter Haddeland. Property owners and public present: Opal Voit and Ed Scheler Others: Elroy Hanson, City Attorney and Germaine Riegert, City Clerk Ed Scheler asked who would bear the cost of updating the abstract of title. Attorney Hanson indicated that no deeds will be issued so that will not be paid for by the City. Who will keep the ditch clean? The City agreed to do that as needed. How will the boundary line be determined? Without a full survey it will have to be a based on pacing off the area. Dan agreed that he will help with this issue. The City of Waubun will bear the cost of recording the vacating resolution. They also agreed to remove the dead tree by the Voit property and get the stump ground out. Mrs. Voit removed her objection to the project. After some discussion, Swiers made a motion to vacate the remainder of Ethel Ave. as described in the formal resolution, in the interest of the public good of the City of Waubun. It was seconded by Wells and duly carried by unanimous vote. Attorney Hanson will prepare the necessary paper work which will be signed off by the Mayor and attested to by the City Clerk.
