CITY OF WAUBUN SPECIAL MEETING THURSDAY, NOVEMBER 2, 2006 The special City Council meeting called for the purpose of settling easement and land use was called to order by Mayor Bill Eck at 5:30 PM at the Waubun Community Center. Roll call was made: William Eck, Thomas Bement, Eugene Moore, and Milo Winter were present. Jean Horack arrived at 6 PM. Staff Present: Germaine Riegert Others present were: Kenneth Lhotka who is developing a parcel of land, Leonard and Lois Wells who have requested a permanent easement for the City Ditch, Chris Thorsen of Ulteig Engineering, Aaron Neubert of the Soil and Water Conservation District and City Attorney, Elroy Hanson. Mayor Eck stated that the purpose of this meeting was to arrive at a mutually acceptable solution with Mr. and Mrs. Wells to repair and refine the ditch that they so graciously allowed us to open to drain the water from the right of way when the Highway 113 Project was being done. Silt had filled in the original ditch to the top of the culvert. This was cleaned out to lower the level to its former path. In the process the culvert was damaged and it needed to be removed or reset. Permission was also being sought to complete the cleaning of the ditch through the Wells property and the City property to the south to allow it to drain into the County Ditch #3. After several minutes of discussion, the City Engineer proposed that a Texas Crossing be installed instead of the culvert. This would be more efficient for drainage of the area which is the main drainage path for the south end of the village. This will require a permit from the Wild Rice Watershed Association which will be prepared immediately as the group meets within a short time. Mr. and Mrs. Wells agreed to this action provided it was done at City cost and that all damages to their property, including the tree, brush and rocks from the first action be cleaned up and removed. Bement made a motion that Ulteig Engineers be directed to draw up the plans and provide a cost estimate as soon as possible so when the permit is approved the project can be completed before freeze up. Attorney Hanson was authorized to prepare the easements needed for the project. Winter seconded the motion and it was approved unanimously. Bement made a motion that Mayor Eck and Clerk Riegert be authorized to sign the easement papers when they are completed without another Council meeting. The motion carried unanimously, Mayor Eck and the Council asked that the official record show that the City of Waubun and its citizens are very thankful to Leonard and Lois Wells for allowing the project to be completed for the benefit of the town. Kenneth Lhotka obtained a permit to build a house on property he owns in the northwest area of the City. He had requested Ottertail Power to dig in the power to the house and was told that he needed an easement from the City to get this done. After some discussion Mr. Lhotka said that the house currently under construction will be the first of several that he will be developing on this acreage. He wanted a road into the development by going north on First St. The SWCD inspected the area as part of the process and expressed concern that there are wetlands that may be affected. The meeting was an attempt to determine the extent of the City of Waubun’s involvement in the process. After a lengthy discussion about the protocol and procedures to be followed, Chris Thorsen suggested that Mr. Lhotka petition the City to do the work on getting the infrastructure surveyed and installed as this is the cleanest way to get the project done. Winter made a motion that the City Engineers work with Mr. Lhotka to get the area surveyed and a plat map developed to determine the right of way for roads and streets, utilities, etc. The motion further stated that the City of Waubun will pay for the installation of the infrastructure initially and recoup their outlay over a period of time through special assessments. Horack seconded the motion and it carried unanimously. Attorney Hanson will draw up the necessary easements so that Ottertail can get the power installed to the house now under construction. No further matters were brought forward. Bement made a motion to adjourn at 7 PM.
